Deputies responded to a physical disturbance between D-1 and D-2, who are adult siblings and live together as a family. Both men had head injuries, which were caused by each striking the other with unidentified metal objects during a physical fight over water usage. Both D-1 and D-2 admitted to fighting one another and each described the other as the primary physical aggressor. D-1 and D-2 were both transported to hospitals for treatment of their head injuries and were medically cleared. The items that were used to inflict the injuries were not identified, nor were they able to be located on the scene. There were no independent witnesses to the incident. D-1 and D-2 were transported to VCBJ under no bond allowed.
Deputy Becker responded to 1956 Pioneer Trail in New Smyrna regarding a domestic disturbance. Contact was made with V-1, who reported she and her 15-year old daughter, D-1, had been involved in a physical altercation before D-1 fled the residence on foot.
V-1 said she arrived home from work and found D-1 was using her phone while in bed, which is against household rules. V-1 said a verbal argument ensued, wherein she attempted to discipline D-1 by slapping her and taking the phone. D-1 became enraged and began kicking V-1 in the abdomen. D-1 then pushed V-1 against the wall and fled the residence. V-1 wished to pursue criminal charges against her daughter.
Deputy Becker completed an affidavit against D-1 for charges of simple battery DV. A search of the area was negative in locating D-1 at that time. A missing person report (190008371) was also completed.
V-1 later called and advised D-1 returned home. She was taken into custody and the screening center evaluated the charges. It was ultimately decided that D-1 would be returned to the custody of V-1. A Notice to Appear in court was issued. D-1 was removed from NCIC/FCIC as a missing juvenile. Juvenile Director Carla Quann was notified.
